Open Health

Terms of Service

Version 2026-11-03 · Effective 3 November 2026

Important: Open Health stores and shares your documents. It does not give medical advice and must not be used in an emergency — call 112. Your password and recovery codes are the only way to unlock your files; if you lose both, we cannot recover them.

1. Who we are

The Open Health app and service (the “Service”) are provided by Magnify Sight SRL, Bucharest, Romania, Trade Register no. J2008018718403 (EUID ROONRC.J2008018718403), CUI RO24696008 (“we”, “us”). Contact: privacy@magnify.ro.

By creating an account you agree to these Terms. Our Privacy Policy explains how we handle personal data.

2. The Service

Open Health lets you digitise, store and selectively share medical documents for yourself and your family. It includes encrypted document storage, family member profiles, time-limited and revocable share links, data export (including FHIR R4 format) and a tamper-evident log of access and sharing events. The Service is currently free of charge.

3. Not medical advice; not for emergencies

Open Health is a document storage and sharing tool. It is not a healthcare provider, not an electronic health record system of a medical institution and not a medical device. It does not interpret documents, diagnose, or recommend treatment, and we do not check that uploaded documents are authentic, complete or clinically correct. Always ask a qualified health professional about medical questions. In an emergency, call 112 or your local emergency number — do not rely on the app.

4. Who can use it

You must be at least 18 years old to create an account and the information you give us must be accurate. You may store documents for family members, including children, only if you are legally entitled to manage their health information or have their explicit permission.

5. Your account and its security

6. Acceptable use

You agree not to:

7. Your content

You keep all rights to the documents and information you upload. You allow us to store, process and transmit them only as needed to provide the Service to you and to the people you choose to share with. We claim no ownership over your records.

The app, its software, design and brand are owned by Magnify Sight SRL or its licensors. You may not copy, modify or distribute them except as allowed by law or by these Terms.

8. Availability and changes to the Service

We work to keep the Service available but cannot guarantee uninterrupted access; maintenance and incidents can happen. We may change or remove features. If we decide to shut down the Service, we will give you at least 90 days’ notice so you can export your data.

9. Ending your use

You can delete your account at any time in Settings → Delete account. Deletion is permanent: your encryption keys are destroyed and your data is erased as described in the Privacy Policy. We may suspend or close an account that seriously or repeatedly breaches these Terms, or where needed to stop fraud, a security threat or unlawful activity; where possible we will tell you first and give you the chance to export your data.

10. Liability

The Service is provided free of charge and “as is”. To the extent permitted by law, we are not liable for: loss of access caused by a lost password and recovery codes; access by others caused by your disclosure of your credentials or share links; indirect or consequential loss; or interruptions outside our reasonable control. Nothing in these Terms limits our liability for intent or gross negligence, for death or personal injury caused by our fault, or any other liability that cannot be limited under applicable law, and nothing affects your statutory rights as a consumer.

11. Changes to these Terms

We may update these Terms. For material changes we will notify you by email or in the app at least 30 days before they take effect. If you do not agree, you can export your data and delete your account before the changes apply.

12. Law and disputes

These Terms are governed by Romanian law. If you are a consumer living in another EU country, you also keep the protection of the mandatory consumer law of that country, and you may bring proceedings in the courts where you live. Otherwise, the competent courts of Bucharest, Romania have jurisdiction. Please contact us first — most issues can be solved quickly. You can also contact the Romanian National Authority for Consumer Protection (ANPC, anpc.ro).

13. App stores

If you downloaded the app from Apple’s App Store, Apple’s Licensed Application End User License Agreement also applies to your use of the app. Apple and Google are not parties to these Terms and are not responsible for the Service or its content.
